1. Acceptance of Terms
By creating an account or using Simena, you agree to these Terms of Service. If you do not agree, do not use the app. We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.
2. About Simena
Simena is an AI-powered mental health coaching app operated by Simena Digital LLC, a Wyoming limited liability company. It provides chat-based coaching with Anthropic's Claude models, voice coaching sessions, mood check-ins, journaling, validated screening assessments, and progress tracking. Simena is a wellness app and is not a substitute for professional mental health care.
3. Account Registration
You can create an account using Apple Sign-In. You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or 16 in the EEA) to use Simena.
4. Subscription & Payments
Simena requires a paid subscription to access coaching features. Subscriptions are billed through Apple In-App Purchase, and the exact price is shown in your local currency on the App Store subscription screen before you confirm a purchase.
- Weekly plan: billed once per week.
- Monthly plan: billed once per month, and includes a 3-day free trial for first-time subscribers.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- You can manage or cancel your subscription in your iOS Settings under Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refunds are handled by Apple according to their refund policy.
- Prices may vary by region and are displayed in your local currency in the App Store.
5. User Content
You retain ownership of the content you create in Simena, including session transcripts, AI chat messages, journal entries, mood check-ins, assessment responses, and voice recordings made during coaching sessions. By using Simena, you grant us a limited license to store and process this content for the purpose of providing the coaching service to you, generating your wellness insights and progress tracking, and ensuring the security and integrity of the service.
You explicitly consent to voice recording when you start a voice coaching session. You may end any voice or chat session at any time, and you may delete your account and all associated content from Settings within the app.
You are responsible for the content you create. Do not use Simena to store or share content that is illegal, harmful, or infringes on others' rights.
6. AI Features Disclaimer
Simena is not a substitute for professional mental health care. The AI coach uses Anthropic's Claude Haiku for routine coaching exchanges and Claude Sonnet for complex or crisis-flagged sessions. It can suggest evidence-based techniques (CBT, mindfulness, ACT, and other approaches drawn from our internal knowledge base) but cannot diagnose conditions, prescribe treatment, or provide medical advice. If you are experiencing symptoms that interfere with daily life, please consult a licensed mental health professional.
Crisis detection is not guaranteed. Our keyword-scanning system surfaces crisis-hotline prompts when self-harm, suicidality, or hopelessness signals are detected, but it may miss subtle or unusual phrasing, sarcasm, metaphor, code-switching, or context-dependent expressions. If you are in crisis, please contact a national hotline or your local emergency services directly — for example, in the United Kingdom, Samaritans (116 123); in Germany, Telefonseelsorge (0800 111 0 111). You can find a helpline for your country at findahelpline.com.
AI responses may be inaccurate. The AI coach can produce factual errors, outdated information, or responses that do not fit your situation. Always verify factual claims — including medication names, professional resource references, diagnostic criteria, and specific therapy modalities — with qualified human professionals before acting on them. AI suggestions are provided for informational and educational purposes only.
7. Third-Party Content
Simena integrates with the following third-party services:
- Apple: Sign in with Apple is used for authentication.
- RevenueCat: Subscription billing and entitlement management.
- Anthropic: Claude Haiku and Claude Sonnet power AI coaching responses.
- Deepgram: Speech-to-text transcription for voice coaching sessions.
- Cartesia: Text-to-speech synthesis for voice coaching responses.
- Expo Updates: Over-the-air updates to the app.
Each provider's own terms and privacy policy apply to those interactions. Simena does not display third-party advertising and does not sell user data.
8. Acceptable Use
You agree not to:
- Use Simena for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service
- Reverse engineer, decompile, or disassemble the app
- Use automated means to access the service (bots, scrapers)
- Impersonate another person or misrepresent your identity
- Submit content designed to harm, harass, or threaten others
- Upload malicious content or code
9. Intellectual Property
Simena, including its design, code, features, branding, knowledge base, and coaching prompts, is the intellectual property of Simena Digital LLC. You may not copy, modify, distribute, or create derivative works based on Simena without our written permission.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Simena Digital LLC and its officers, employees, and agents shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of Simena
- Inaccuracies in AI-generated coaching responses or suggestions
- Missed, delayed, or false-positive crisis-detection alerts
- Service interruptions, downtime, or data loss
- Any mental-health outcomes resulting from reliance on Simena, including but not limited to decisions you make based on AI coaching responses
- Issues arising from third-party services integrated with Simena
Simena is provided "AS IS" without warranties of any kind, express or implied. Use Simena as a supplement to, not a replacement for, professional mental health care. Our total liability to you for any claims arising from or related to Simena shall not exceed the amount you paid for the service in the 12 months preceding the claim.
11. Account Termination
You may delete your account at any time from Settings within the app. Deletion is soft-applied immediately — your active session is ended and your Apple refresh token is revoked — and finalized after 30 days. During this 30-day grace window you may restore your account by signing in again with the same Apple ID. After 30 days, your session transcripts, journal entries, mood logs, assessment results, voice session transcripts, and all other account data are permanently and irreversibly deleted.
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose a security risk to other users or the integrity of the service.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of Simena shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with the rules of the American Arbitration Association.
13. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
